2. The present writ petition has been preferred for the following relief(s):

(i) For issuance of writ in the nature of mandamus commanding and directing the respondents authority to pay adequate compensation to the petitioner against the acquisition of the land which was acquired for the purpose of construction of Ring Dam on the Jhim Jamura river.

(ii) For further direction to the respondents authority to make an enquiry

Patna High Court CWJC No.4343 of 2017(4) dt.15-09-2025 2/3 that whether the land acquired by the respondents authority of the petitioner is of residential purposes or not and if it is found that the land is of residential purposes revised the Award and pay compensation accordingly.

(iii) For further direction to the respondents authority to dispose off the representation of the petitioner by reasoned and speaking order within time framed.

(iv) And for any other relief/reliefs for which the petitioner is found to be entitled in the eye of law.

3. The paragraph 7 of the counter affidavit filed by the District Land Acquisition Officer, Gandak Project, Muzaffarpur shows that all the objections were taken note of, disposed of and after the enquiry took place, the land (under acquisition) were classified as Class II land, rate fixed/assessed and thereafter the payment was made @ Rs. 4,74,363/- per acre, accordingly, the estimate was prepared/ sanctioned by the Collector, Sitamarhi and the award was declared.

4. Further, no residential land was acquired under the aforesaid land acquisition proceeding and in that background, the District Classification Committee classified

5. Be that as it may, since there is no appearance, dismissed.
