The petitioner is apprehending his arrest in a case registered under Sections 420, 406, 468, 465, 470 and 471 of the Indian Penal Code.
The prosecution case, in brief, is that the land in question was fraudulently transferred to the informant, which had earlier been transferred to a third party.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in this case. Except the allegation made in the FIR, there is no documentary evidence to
Patna High Court Cr.Misc. No.53159 of 2018 (2) dt.20-09-2018 show the involvement of the petitioner in the present case. The matter relates to a civil dispute.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhubani in connection with Jaynagar P.S. Case No. 222 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
