The petitioner apprehends his arrest in connection with Rohtas P.S. Case No. 315 of 2018 for the offence punishable under Section 409/34 of the Indian Penal Code. Petitioner happens to be the Panchayat Secretary of Nawadih Panchayat. Petitioner is said to have withdrawn Rs. 2, 07,500/- under Thirteen Finance Commission to carry out the construction work of Aganbari Center building, but the aforesaid work was not done by the petitioner and he defalcated the aforesaid amount.

Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. Petitioner has been

He had carried out the work of Rs.1,08,750/- and deposited the rest amount of Rs.1,01,128/- to the department. The Block Development Officer, vide his letter dated 18.1.2019 has informed the Additional Collector, District- Rohtas about adjustment of the defalcated amount by the petitioner.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Vivek Kumar Singh, J.M. 1st Class, Dehri (Rohtas) in connection with Rohtas P.S. Case No. 315 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
