The petitioner seeks bail in a case registered under Sections 302, 307/34 of the Indian Penal Code and 27 of the Arms Act. The prosecution case, in brief, is that while the informant's son and his cousin were taking refreshment, 11 accused persons including the petitioner riding on five motorcycles, came there and started indiscriminate firing, as a result of which, informant's son and his cousin sustained grievous injuries and both of them died in course of treatment.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 06-11-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. General and omnibus allegation has been made

Patna High Court CR. MISC. No.29050 of 2019(4) dt.17-08-2019 2/2 against the petitioner. Neither specific overt act is alleged nor any specific injury is attributed against the petitioner. On behalf of the State and the informant, it is submitted that the petitioner is named in the Complaint Case/F.I.R. It is a case of double murder in which, two persons died in the occurrence of indiscriminate firing made by 11 persons including the petitioner. One of the deceased sustained as many as 8 injuries and the other deceased is said to have received four injuries, caused by fire arms. The postmortem report corroborates the allegation made in the FIR. It is also submitted that prayer for bail of other accused persons has been rejected by order dated 21-06-2019 passed in Cr. Misc. Nos. 16242 of 2019 and 22688 of 2019 analogously.

Considering the facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Runnisaidpur P.S. Case No. 663 of 2018 is rejected.

The trial court is directed to take all possible steps to expedite the trial and conclude the same, preferably within a period of one year from the date of receipt/production of copy of this order. (Sudhir Singh, J) A.K.V.//- U T
