JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 05-08-2022 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State through virtual Court proceedings.
Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioners seek bail in connection with Rail Patna (Junction) P.S. Case No. 134 of 2022 registered for the offence under Section 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The allegation against the petitioners is to have in possession of total 131.05 liters of foreign liquor. Learned counsel appearing on behalf of the petitioners submitted that recovery of illicit liquor was made from the toilet of a coach of train, which was jointly occupied by four accused persons. It is submitted that seizure list is disputed, as same is not supported by independent witnesses, in view of the Section 100(4) of the Cr.P.C., which creates a doubt over the entire seizure list. It is pointed out that petitioner no.1 is involved in one more criminal case, in which he is on bail and petitioner nos. 2,3 and 4 are persons of clean antecedent. While concluding the argument, it is submitted that investigation in this case is complete for which chargesheet has been submitted, as such, there is no chance of tampering with the evidence. Learned APP appearing on behalf of the State, while opposing the prayer of bail, fairly conceded that seizure list is not supported by independent witnesses.
Considering the facts and circumstances as mentioned above, as seizure list is disputed coupled with the fact that chargesheet has already been submitted, let the petitioners,
