The issue raised in the present writ petition is no more res integra. It has been decided by a Division Bench of this Court in CWJC No. 14009 of 2006 and analogous cases and
Patna High Court CWJC No.17776 of 2012(5) dt.11-10-2018 2/2 following that decision of the Division Bench this Court has passed oral judgment on 10.09.2018 in CWJC No. 13296 of 2012.
On the ground of parity this writ petition is disposed of on the same line of CWJC No. 14009 of 2006 which was decided by the Division Bench on 30.4.2013. The respondents are directed to follow the aforesaid decision of the Division Bench in the case of the petitioner and pass appropriate order within a maximum period of four months from the date of receipt/production of a copy of this order.
With the aforesaid, the writ petition stands disposed of.
