JUSTICE BIRENDRA KUMAR ORAL ORDER 02-11-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 395,397 of the Indian Penal Code.

The FIR of the occurrence of dacoity is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused.

Submission is that case diary would reveal that there is no other material against the petitioner. Considering the fact that there is no substantial material against the petitioner to compel the petitioner to go to jail, let the petitioner, above named, in the event of
