2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Banmankhi P.S. Case No. 499 of 2023 registered for the offences punishable under Sections 379, 401, 413, 411 of IPC.

3. As per FIR three unknown person came on their respective motorcycles and were in process to take up three buffaloes of the informant, which was seen by the daughter-in-law of the informant. The FIR also suggests that the informant alongwith co-villagers chased accused persons, where one person was apprehended namely, Suraj Sah, who disclosed that

It is submitted by learned counsel appearing on behalf of the petitioner that petitioner and their friends were watching dance at informant's place and while enjoying the performance of dances, some hot exchange of words took place between the parties and under conspiracy, the present false case was lodged implicating petitioner and other co-accused persons. It is further submitted that implication of this petitioner was made on the basis of suspicion arising out of disclosure made by the apprehended co-accused person namely, Suraj Saj. Petitioner claimed clean antecedent.

5. Learned APP opposes the prayer of bail.

6. In view of aforesaid factual submissions and by taking note of fact as the implication of this petitioner prima-facie appears due to suspicion arising out of disclosure made by apprehended co-accused person, accordingly petitioner above-named, in the event of his

No.31017 of 2026(2) dt.13-05-2026 3/3 arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ XV, Purnea /concerned Court, where the case is pending in connection with Banmankhi P.S. Case No. 499 of 2023, subject to the conditions as laid down under Section 482(2) of BNSS.
