The petitioner in the present case is seeking transfer of Matrimonial (Divorce) Case No. 207 of 2016 from the Court of learned Principal Judge, Family Court, Nawada to the Court of learned Principal Judge, Family Court, Patna. Learned counsel for the petitioner submits that at least three cases between the parties are going on at Patna since the Year 2014, therefore, the present case filed in the year 2016 by the Opposite Party at Nawada may also be transferred to Patna. It is further submitted that the petitioner is not having good health condition and it would not be possible for her to visit Nawada on the date fixed in the matter.
Patna High Court MJC No.2745 of 2017 (4) dt.31-08-2018 2/2 Learned counsel representing the Opposite Party has at this stage submitted that he is not opposing the application for transfer.
In the submission advanced on behalf of the Opposite Party, let the records of this case be transferred from the Court of learned Principal Judge, Family Court, Nawada to the Court of learned Principal Judge, Family Court, Patna within a period of 15 days from the date of receipt/ production of a copy of this order. On receipt of the record, learned counsel for the Opposite Party may mention the matter before the learned Principal Judge, Family Court, Patna for fixing the date and on such request the learned Principal Judge, Family Court, Patna shall fix the date within a reasonable time and shall proceed to conclude the case expectedly within nine months from the date of receipt/production of a copy of this order.
The application stands disposed off.
