2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 323, 307, 504, 506 of the Indian Penal Code.

3. As per the prosecution case, all the FIR named accused persons assaulted one Raushan Kumar over his head causing his death.

4. As per FIR, named accused persons killed the deceased. Petitioner was neither named nor there was any whisper about him. Name of petitioner transpired in this case on the basis of further statement of informant in which he took the name of accused persons including petitioner who assaulted Raushan Kumar due to which he died. There is no eye-witness of the occurrence. There is no direct or indirect material against

5. Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Nawada in connection with Sirdala P.S. Case No. 126 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
