JUSTICE P. B. BAJANTHRI) 21-07-2023 The present contempt petition is for non-compliance of the order dated 22.04.2011 passed in LPA No. 794 of 2010. There is enormous delay of more than one decade, in compliance of the orders of this Court, as is evident from the dates of events.
2. Today, learned counsel for the opposite partiesBihar State Co-operative Marketing Union Ltd.,Patna furnished show-cause along with the cheque which has been furnished in the name of the petitioner, and it is handed over to the learned
Patna High Court MJC No.754 of 2017(8) dt.21-07-2023 2/2 counsel for the petitioner. The cheque amount is a sum of ₹2,58,312/- (Rupees Two Lakhs Fifty Eight Thousand Three Hundred Twelve Only), therefore, there is a compliance to the orders of this Court.
4. Due to delay in compliance for more than one decade, the petitioner is entitled to cost of the present litigation and it has been quantified at ₹25,000/- (Rupees Twenty Five Thousand Only). Cost shall be paid to the petitioner within a period of four weeks' from today, in the event of non-payment adverse order would be passed in future date. In this regard, petitioner is at liberty to file Interlocutory Application for revival of the present order.
4. Accordingly, the present MJC-contempt petition stands disposed of.
