JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 20.09.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dharahara (Hemzapur) P. S. case no. 64/2018 registered under sections 307, 379 and other allied sections of the IPC. There is allegation against the petitioner that he assaulted injured Rakesh Singh by means of iron rod. The written report of the informant reflects that alleged occurrence took place on account of land dispute and the informant and his brother were mercilessly assaulted by the petitioner and his associates. Informant's brother sustained, altogether, nine injuries.

Patna High Court Cr.Misc. No.57385 of 2018 (2) dt.20-09-2018 Considering the aforesaid facts and circumstances, I do not feel it proper to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail stands rejected. However, it is made clear that this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail of the petitioner.
