====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-11-2020 Heard Mr. Anil Kumar Sinha, learned counsel for the petitioner and Mr. Ram Priya Sharan Singh, learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Dariyapur P. S. Case No. 105 of 2018 dated 21.04.2017, instituted for the offences under Sections 366(a), 504, 506 and 34 of the Indian Penal Code.

The petitioner is alleged to have eloped with the daughter of the informant.

The learned counsel for the petitioner has submitted that the victim girl has given her statement

Patna High Court CR. MISC. No.25681 of 2020(3) dt.24-11-2020 2/3 under Section 164 Cr.P.C., in which she has specifically stated that now she is married to one Ujjawal Kumar. In her statement, she has also stated that she had left her parental home along with the petitioner of her own volition and was not ill treated by the petitioner in any manner whatsoever.

The other accused persons of this case have been granted anticipatory bail by a Bench of this Court in Cr. Misc. No. 22754 of 2019 by order dated 01.08.2019.

Considering the facts of this case in its entirety, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of ten weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Dariyapur P. S.

Patna High Court CR. MISC. No.25681 of 2020(3) dt.24-11-2020 3/3 Case No. 105 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
