Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. The petitioner apprehends his arrest in connection with Sabour P.S. Case No. 357 of 2020, registered for the offences punishable under Sections 302 & 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR, there was some dispute between coaccused Prabhu Yadav and Sunni Yadav (deceased) for transaction of money. On 15.12.2020 at about 4 pm co-accused Prabhu Yadav and Yogesh Yadav took the deceased by their

Patna High Court CR. MISC. No.41004 of 2021(2) dt.09-02-2022 2/2 motorcycle, thereafter, they along with other co-accused persons committed murder of Sunni Kumar, the husband of the informant, Sanjana Kumari, by conspiracy.

During the course of investigation co-accused Jyotish Yadav was arrested and in his self inculpatory confessional statement, confessed his guilt and has stated that he shot dead the deceased by his pistol. He named the present petitioner amongst one of the conspirator of the alleged occurrence. In my view, it is not a fit case for anticipatory bail. Accordingly, it is rejected.

The petitioner is directed to surrender before the court below and pray for regular bail.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
