JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This application, for grant of anticipatory bail, arises out of Banka (Barahat) P.S. No. 465 of 2018, disclosing offences under Sections 147, 148, 149, 307, 323, 337 of the Indian Penal Code.

Allegation against the petitioner is hurling bomb causing injury on the leg of the informant.

Submission of learned counsel for the petitioner is that there is land dispute between the parties and the land has illegally been settled in favour of the informant and when the petitioner protested this false case has been lodged. Further submission is that there is case and counter case and injuries have been sustained by both sides.

Having heard both sides, in view of allegation of hurling

Patna High Court CR. MISC. No.34917 of 2019(3) dt.07-08-2019 2/2 bomb on informant, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner if so desire, may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, if possible on same day, without being prejudiced by this order.
