JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This is an application for grant of anticipatory bail in connection with Barauni P. S. Case No. 327 of 2018, disclosing offences under Sections 406, 409, 420 of IPC. Prosecution case in short is that petitioner is engaged in selling the illegal diesel.

Submission of the learned counsel for the petitioner is that as a matter of fact, he has lodged the case earlier before lodging of this case against the informant stating the fact that informant and his father is Contractor of IOC limited and vehicle proceeded by IOC limited and informant and his father got the challan. The driver to come on the next day, he was told that loaded lorry will be handed over after two days and when the driver ask for handing over the lorry, he threatened for dire consequences. It has also been submitted that in order to save

Patna High Court CR. MISC. No.37177 of 2019(4) dt.19-09-2019 2/2 his skin, the present case has been lodged. Considering the fact, this Court has granted privilege of anticipatory bail, vide order dated 03.04.2019 passed in Criminal Misc. No. 18135 of 2019. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Begusarai, in connection with Barauni P. S. Case No. 327 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
