The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 341, 323, 324, 307, 354 of the Indian Penal Code.

The prosecution case, in short, is in the backdrop of leakage of water in the field of informant, a dispute arose as a result of which the accused persons assaulted the informant. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. There is a case and counter case between the parties.

Patna High Court Cr.Misc. No.52701 of 2018(2) dt.11-09-2018 2/2 There is general and omnibus allegation has been levelled against the petitioners. No specific overt act has been alleged against the petitioners. Other co-accused has been granted anticipatory bail vide Annxure-3.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -I, Danapur, Patna in connection with Bihta P.S. Case No. 957 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
