The petitioner seeks bail in Tariyani P.S. Case No. 26/2019, instituted for offence under Section(s) 420, 406 and 120(B) of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence informant had gone to Narwara Indian Bank for withdrawing money. The informant made request to one person to fill up the withdrawal form. Thereafter the informant withdrew Rs. 30,000/-. It is alleged that the person who had filled up the withdrawal form for the informant took money from the hand of informant. Later on that person gave a handkerchief to the informant and went outside from the Bank. The informant opened the handkerchief and found only chit of

Patna High Court CR. MISC. No.28794 of 2019(2) dt.06-05-2019 2/2 paper. Money was not there.

Learned counsel for the petitioner has submitted that there is no recovery of money from possession of this petitioner. He has been made accused in this case merely on suspicion. Petitioner is in custody since 09.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar, in connection with Tariyani P.S. Case No. 26/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
