This application for anticipatory bail arises out of Phulparas P.S. Case No. 07 of 2014, disclosing offences punishable under Section 364 of the Indian Penal Code. The victim, allegedly kidnapped, is said to be the petitioner's father. The First Information Report was registered in 2014. No justifiable explanation is forthcoming why steps for seeking anticipatory bail has been initiated only in 2019. The petitioner has been declared absconder, which is an admitted fact.

Considering the above, this application is dismissed. The petitioners is directed to surrender before the Court below within four weeks from today and seek regular

Patna High Court CR. MISC. No.29715 of 2019(2) dt.06-05-2019 2/2 bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
