11-01-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in Sadar (Muffasil) P.S. Case No. 39 of 2020, registered for the offence punishable under Section 395 of the Indian Penal Code.
As per the prosecution case, three motorcycle borne miscreants snatched the bag of informant containing Rs. 110383/- alongwith other valuable documents, such as; Pan card, Aadhar card, I.D. card of Bank etc. It is further alleged that 6-8 persons were involved in the aforesaid incident. It is submitted on behalf of petitioner that petitioner is not named in the FIR and name of petitioner has come on the confessional statement of co-accused Jamaluddin. No incriminating article has been recovered from the possession of the petitioner.

No.30029 of 2020(3) dt.11-01-2021 2/2 However, learned A.P.P. for the State has opposed the bail application and submitted that during course of investigation, in paragraph - 33 of the case diary, it has come that incriminating articles including Pan card, Aadhar card etc. have been recovered on the disclosure made by this petitioner.
