JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2015 Petitioner is languishing in custody since 15.06.2014 in a case registered for the offences punishable under Sections 302/34 of the I.P.C.
It is alleged that informant, his mother and three sisters were not on good terms with their father. On the alleged date of occurrence they were sleeping to someone else's house and in the morning the informant found his father dead. During investigation it transpired that the wife of the victim Laxmi Devi along with her son-in-law Laxman Yadav hired this petitioner for committing murder of the victim for which the petitioner was paid Rs. 5000/-. On confession of the petitioner blood stained sickle was recovered.
It is submitted by learned counsel for the petitioner that co-accused Lakshman Yadav who is alleged to have hired this petitioner has been granted bail vide Cr. Misc.
Patna High Court Cr.Misc. No.16257 of 2014 (4) dt.03-02-2015 2/2 No. 32121 of 2013.
Considering the fact that on confession of the petitioner blood stained sickle was recovered, this Court is not inclined to grant bail to the petitioner at present. However, if the trial will not be concluded within a period of one year then the petitioner will be at liberty to renew his prayer for bail. Accordingly the application is dismissed in connection with Jhajha P.S. Case No. 89 of 2013, pending in the Court of learned 1st Additional Sessions Judge, Jamui. (Dinesh Kumar Singh, J) Shageer/- U T
