The petitioner apprehends his arrest in connection with Complaint Case No. 1086 of 2016, registered under Sections 406, 420, 120(B), 504 and 506 of the Indian Penal Code.

The accusation is that petitioner asked to the complainant/O.P. No.2 Jagarnath Singh to spend money for fixing tower of Airtel Company for earning and also providing job as Guard to his son. Accordingly, the informant paid Rs. 45000/- on different occasions to the petitioner, but the said tower was not fixed on the land of the complainant/O.P. No.2

Patna High Court CR. MISC. No.32993 of 2019(2) dt.21-05-2019 2/2 and, thereafter, complainant/O.P. No.2 approached to the petitioner to return the money, but petitioner did not return his money.

Learned counsel for the petitioner submits that, in fact, petitioner is the collection executive of U.Co Bank, Bharko and in that course he had gone at the house of the complainant/O.P. No.2 to giving notice to deposit Rs. 51,000/- as due installments to the Bank and on much pursuation the complainant/O.P. No.2 did not receive the notice and filed the present case with false allegation against the petitioner. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Banka in connection with Complaint Case No. 1086 of 2016, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
