Petitioner apprehends arrest in a case registered for the offence punishable under Sections 270, 271, 307 and other sections of Indian Penal Code and Section 3 of The Epidemic Diseases Act, 1897.

As per prosecution case, informant and others were obstructed by the petitioner and others in discharging of their official duties and assaulted them during COVID-19 lockdown. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Moreover, there is general and omnibus allegation of assault against the petitioner and no specific overt act has been alleged against the petitioner. Petitioner has got clean antecedent.

No.29915 of 2022(2) dt.29-09-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in Dagarwa P. S. Case No. 58 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
