This application is filed for grant of regular bail in connection with Saraiya Police Station Case No. 854 of 2022 registered for the offence under Sections 272, 273 & 34 of Indian Penal Code and Sections 30(a), 32(3) and 41(i) of the Bihar Prohibition & Excise (Amendment) Act, 2022. Learned counsel for the petitioner submits that there is recovery of 594.720 litres of illicit foreign liquor and also the petitioner is in custody since 24.03.2023 also the petitioner has one similar antecedent.

Learned A.P.P. has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.32749 of 2023(2) dt.23-05-2023 2/2 Considering the period of custody the petitioner and the nature of allegations levelled against the petitioner, this application is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No.II, Muzaffarpur, in connection with Saraiya Police Station Case No. 854 of 2022.
