The petitioner seeks bail in Kochadhaman P.S. Case No. 171 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence while the informant was returning on his motorcycle with cash of Rs. 1,05,115/-, official documents and tablet, on the way, two unknown miscreants stopped his vehicle and on the point of pistol looted cash, official document and tablet and fled away.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case. No incriminating article has been recovered from possession of this

Patna High Court CR. MISC. No.40612 of 2021(2) dt.16-12-2021 2/2 petitioner. No test identification parade has been held till date. Petitioner has been remanded in this case from Kochadhaman P.S. Case No. 214 of 2020 on 15.01.2021 and since then he is in judicial custody.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kochadhaman P.S. Case No. 171 of 2020.
