The present review petition has been filed against the order 31.01.2012 passed by this Hon'ble Court in C.W.J.C.No.9042 of 2002. It appears that the order was passed in presence of the Addl. Collector, Siwan on the averment made by the Additional Collector, Siwan, who was personally present in the Court.

Learned counsel for the State submits that counter affidavit was filed, but contents of the counter affidavit could not be taken into consideration. It appears that learned counsel for the State had made wrong submission. No counter affidavit

Patna High Court C. REV. No.137 of 2013(5) dt.22-11-2019 2/2 was filed till the date of the order i.e. 31.01.2012. It is submitted that the father of the petitioner has already received the compensation amount for the acquisition of his land for vesting of the Estate in the State of Bihar, but this fact was brought on record by the State and the Addl. Collector appeared and the remaining amount of compensation was to be paid.Thus, I do not find any apparent error on the face of the record. Taking into consideration of the facts and circumstances, I do not find any ground to review the order dated 31.01.2012 passed in C.W.J.C.No.9042 of 2002. The review petition is dismissed.
