The petitioners in the present case are seeking anticipatory bail in connection with Amarpur P. S. Case No. 127 of 2018 registered for the offences punishable under Sections 341, 323, 307, 504, 506, 385/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that there are general and omnibus allegations against all the petitioners. The allegation is that all of them have assaulted the informant by means lathi, danda and iron rod, however, the injury report available at Annexure-2 shows only one injury which is simple in nature.

Learned APP has opposed the prayer of bail of the petitioners.

Considering the facts and circumstances wherein it is submitted that there are general and omnibus allegation against all the petitioners and only one simple injury has been found as per Annexure-2 of the present application, let the petitioners above named in case of their arrest or surrender in connection with Amarpur P. S. Case No. 127 of 2018 within a period of four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
