The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 341, 323, 365 of the Indian Penal Code and Section 5 of Child Marriage Restraint Act. The prosecution case, in brief, is that the minor son of the informant namely Navneet Kumar was kidnapped by the petitioners and others. It is also alleged that forcefully, the marriage of daughter of petitioner No. 1 was solemnized with the said Navneet Kumar.

It has been submitted on behalf of the petitioners that the

Patna High Court Cr.Misc. No.52348 of 2018 (2) dt.10-09-2018 petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. As per allegation, the minor son of the informant has got married with daughter of petitioner No. 1. So far rest petitioners are concerned, they are agnates of petitioner No. 1. There was love affairs between the daughter of petitioner No. 1 and son of the informant which led to their marriage.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No. 48 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
