The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

As per prosecution case, the petitioner who is ExGuest teacher misappropriated in the register with respect to Guest Teacher Employment (2020-21) and also made defalcation in the collected revenue and receipt thereof, causing problem in providing up-to-date information to the department. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the petitioner has deposited the amount in the

Polytechnic, Gaya on different dates, which is evident from the Annexure-3 series to this petition and there is no dues pending against this petitioner. Petitioner has submitted his representation dated 30.09.2021 before the Principal. However, learned APP opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Vishnupad P.S. Case No. 04 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
