This application for anticipatory bail arises out of Fatuha P.S. Case No.164 of 2018, disclosing offences under Section 436 of the Indian Penal Code.
Mr. Sandeep Kumar, learned counsel appearing on behalf of the petitioners submits that this is the second criminal case lodged by the family of the informant against these petitioners. Earlier the father of the informant had lodged Fatuha P.S. Case No. 480 of 2017 for the offence punishable under Sections 406 and 420 of the Indian Penal Code, falsely in which they have been granted anticipatory bail. He contends that implication of these petitioners in the present case is absolutely
Patna High Court Cr.Misc. No.52055 of 2018(2) dt.28-09-2018 2/2 malicious. He further submits that in any event, the petitioners are not likely to flee away from the course of investigation or trial, if released on bail.
Considering the above submissions, this application is allowed.
Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna City in Fatuha P.S. Case No.164 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
