JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-03-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Khutauna P.S. Case No. 09 of 2020 for the offence under Sections 341, 323 and 307 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner has got no criminal antecedent. It is alleged that this petitioner has thrown the daughter of the informant in Koshi river, however she survives. Petitioner is in custody since 01.02.2020.

Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for more than one year, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing
