The petitioner is apprehending their arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
Allegedly, the petitioner did not hand over the charge of PACS to the new incumbent of PACS and he also caused hindrance in the functioning of business of PACS. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that so far allegation of not giving the charge is concerned, for that Section 45(A) and 45(B) of the Co-operative Society Act are attracted against the petitioner and the same are bailable.
Patna High Court CR. MISC. No.31097 of 2022(2) dt.16-11-2022 2/2 Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Arti Kumari, Judicial Magistrate-Ist Class, Muzaffarpur in connection with Katra P.S. Case No. 221 of 2020, G.R. No.5098 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
