====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2023 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 436, 506/34 of the Indian Penal Code.
3. According to F.I.R., on the alleged date and time of the occurrence, three named accused persons including this petitioner set the shop cum house of the informant on fire. It is further alleged that prior to the alleged date of occurrence, the accused persons threatened the informant to remove the shop in question from its place other wise it would be burnt. Dispute occurred between the parties while playing Dholak.
4. It is submitted on behalf of the petitioner that the informant is next door shop owner and due to petty dispute the petitioner and his entire family have been implicated in this
Patna High Court CR. MISC. No.31910 of 2023(4) dt.20-09-2023 2/2 false and fabricated case. It is further submitted that during investigation no burnt articles have been found from the alleged place of occurrence. Rest of the allegations are ornamental. Petitioner has got clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Khagaria in connection with Pasraha P. S. Case No. 202 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
