This application for regular bail arises out of Beldaur P.S. Case No. 140 of 2020, disclosing offences punishable under Sections 395 and 412 of the Indian Penal Code. Petitioner's prayer for regular bail was earlier rejected by an order of this Court dated 05.01.2021 passed in Cr. Misc. No. 31526 of 2020 with an observation that if charge was not framed, the petitioner shall be at liberty to renew his prayer for bail. Accordingly, this application has been filed seeking grant of regular bail.

Mr. Viveka Nand Singh, learned counsel appearing on behalf of the petitioner has made two fold submissions. He has firstly submitted that charge has not been framed so far and secondly similarly circumstanced co-accused persons, namely, Rahul Singh @ Rahul Kumar Singh @ Kumar Abhishek and

Patna High Court CR. MISC. No.41212 of 2021(2) dt.11-08-2021 2/2 Sagar Sah @ Shiv Sagar Kumar have been allowed regular bail by this Court respectively by order dated 28.06.2021 passed in Cr. Misc. No. 5178 of 2021 and order dated 27.07.2021 passed in Cr. Misc. No. 11976 of 2021.

Considering the above submission and the observations made by this Court in the order passed in Cr. Misc. No. 31526 of 2020, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Khagaria, in Beldaur P.S. Case No. 140 of 2020.
