This application for regular bail arises out of Adapur (Harpur) P.S. Case No. 291 of 2019, disclosing offence punishable under Sections 302, 201, 120-B/34 of the Indian Penal Code.

It has been rightly pointed out by the learned counsel for the petitioner that three persons named in the FIR, namely, Subhash Kushwaha, Mukhlal Kushwaha and Sajawal Mahto have been allowed regular bail by this Court by an order dated 14.10.2020, passed in Cr. Misc. No. 25808 of 2020 on the basis that the FIR did not disclose any material foundation for their implication nor any basis to suspect their involvement. The petitioner is brother of the deceased. The informant was not

Patna High Court CR. MISC. No.25804 of 2020(5) dt.03-12-2020 2/2 present in her in-laws house when the deceased was allegedly killed. The dead body of the deceased was found lying in a paddy field.

Considering the circumstance that other co-accused persons have been allowed regular bail by this Court as noted above, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul, East Champaran at Motihari, in Adapur (Harpur) P.S. Case No. 291 of 2019.

It is directed that defects in the application pointed out by the Registry must be removed within two months from today. (Chakradhari Sharan Singh, J) Rajesh/- U T
