JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-12-2020 Heard Mr. Abhishek Kumar, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Dhaka P.S. Case No. 51 of 2020, dated 01.02.2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 188, 332, 333, 353 and 295 of the Indian Penal Code.

The petitioner and another are said to have disturbed the procession which had come out for immersion of the statue of Goddess Saraswati. The police party also was prevented from discharging its official duties.

The occurrence is said to have taken place in a state of frenzy while a religious procession was going on. Regard being had to the nature of accusation against the petitioner and taking into consideration that he does not have criminal antecedents, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Dhaka P.S. Case No. 51 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
