Claim of subsistence allowance for the period of suspension has been raised in the instant proceedings. Learned counsel for the petitioner submits that the entire departmental proceeding has been quashed subsequently in CWJC No 12883 of 2019 wherein this Court has directed that petitioner would be entitled to subsistence allowance during the period he remained under suspension.

In view of the submission of learned counsel for the petitioner, this Court would observe that there is no occasion for

Patna High Court CWJC No.10405 of 2019(2) dt.29-08-2019 2/2 this Court to pass the same order in the instant case, which is a successive writ petition for the same relief. Writ petition is, accordingly, dismissed.
