JUSTICE SHAILENDRA SINGH ORAL ORDER 13-08-2025 Heard Mr. Mritunjay Kumar, learned counsel for the Petitioner, Mr. Vinay Kumar Singh, learned counsel for the informant and Mr. Ram Bilash Roy Raman, learned APP for the State.
2. Petitioner seeks regular bail in connection with Thakurganj P.S. Case No. 14 of 2025, dated 25.01.2025, registered for the offences punishable under sections 96, 137(2) and 3(5) of the Bharatiya Nyaya Sanhita (in short 'BNS'). Further, vide chargesheet bearing C.S. No. 40/25, dated 28.02.2025, offences under sections 96, 137(2), 140(3), 61(1) and 65(1) of the BNS and section 4 of the POCSO Act have been submitted by the investigating officer against the petitioner.
3. The main submissions advanced by petitioner's counsel are that the petitioner is a 19 year old boy and the instant matter relates to love affair between the petitioner and the victim
Patna High Court CR. MISC. No.31284 of 2025(4) dt.13-08-2025 2/2 and the FIR was registered by the victim's father with malice intention. It is further submitted that the petitioner has been languishing in jail since 24.02.2025 and his trial has already started and he has filed the copy of the charge framed upon him by way of a supplementary affidavit. It is lastly submitted that the socalled victim did not support the allegations made in the FIR in her statement recorded under section 183 of the BNSS.
4. Learned counsel appearing for the informant has vehemently opposed the prayer of the petitioner and submits that against this petitioner, there is serious allegation as he is accused of establishing sexual relationship with a minor girl.
5. Learned APP appearing for the State has also opposed the prayer of the petitioner.

Considering the aforesaid submissions and mainly the petitioner's young age, his custody period and victim's statement recorded under section 183 of the BNSS, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Thakurganj P.S. Case No. 14 of 2025.
