2. The petitioner seeks bail in Akbarpur P.S. Case No. 289 of 2023, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 180 litres country made liquor has been recovered from a canal (Paine).

4. It is submitted by learned counsel appearing on behalf of the petitioner that name of petitioner has transpired in this case during course of investigation. It is further submitted that nothing has been recovered from conscious possession of this petitioner and he is in custody since 30.03.2024. Moreover, chargesheet has already been submitted.

5. Learned A.P.P. for the State has vehemently

Patna High Court CR. MISC. No.38969 of 2024(2) dt.23-08-2024 2/2 opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, nature of accusation and period of custody, the prayer for bail of petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-1st, Nawada, in connection with Akbarpur P.S. Case No. 289 of 2023.
