Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in Muffasil P.S. Case No. 67 of 2020, registered for the offences punishable under Sections 147, 148, 149, 307, 323, 324, 341, 447, 504 and 506 of the Indian Penal Code.

The informant alleged that on 11.02.2020 at 5.00 pm, all the accused persons including this petitioner entered into the house and started abusing. On protest, petitioner ordered to kill the informant upon which, co-accused Subodh Rai gave Katta blow on the neck and elbow of the informant, causing cut injury.

Patna High Court CR. MISC. No.29825 of 2020(2) dt.16-12-2020 2/2 When his mother came to save him, she was also assaulted by Subodh Rai by means of Katta causing cut injury on her arm. It is further alleged that earlier also, the petitioner and his family members assaulted his father and mother for which a case is pending and petitioner and others are making pressure to compromise the case.

It is submitted on behalf of petitioner that petitioner is only order giver. Allegation of assault is against other coaccused persons. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Samastipur in connection with Muffasil P.S. Case No. 67 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
