JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State, assisted by learned counsel appearing for opposite party no. 2. Petitioner apprehends his arrest in connection with Complaint Case no. 295(c) of 2018, registered for the offences punishable under Sections 323, 504, 498(A), 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Petitioner happens to be husband of opposite party no. 2 and according to the prosecution case, the marriage of petitioner was solemnized with opposite party no. 2 on 14.04.2016 in a temple. The opposite party no. 2 claims that

Patna High Court CR. MISC. No.31620 of 2019(4) dt.16-11-2019 2/2 when she went to her in-laws house, she was subjected to cruelty and harassment by the petitioner.

Earlier, the dispute of the parties was referred to Mediation Centre, Patna High Court, Patna, where the petitioner and opposite party no. 2 appeared but learned Mediator reported, vide his report, dated 05.09.2019, that due to noncooperation of opposite party no. 2, the mediation could not succeed on the first meeting of mediation.

Considering the facts and circumstances of the case as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner, above named, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-IInd, Barh, Patna in connection with Complaint Case No. 295 (C) of 2018, subject to conditions as laid down under Section 438(2) of the CrPC.
