JUSTICE PARTHA SARTHY ORAL ORDER 02-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The instant application for regular bail has been filed by the petitioner in connection with Chapra Mufassil P.S. Case No. 188 of 2020 registered against three unknown under section 394 of the Indian Penal Code.
As per allegation in the F.I.R., while the informant was returning on his motorcycle, it is stated that three accused persons overtook the informant and on the point of knife, dispossessed the informant of his motorcycle and other valuables.
It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in course of investigation when it was informed by spy of the police that three accuse persons including the petitioner herein were seen
Patna High Court CR. MISC. No.27734 of 2020(3) dt.02-12-2020 2/2 on a motorcycle in the area prior to the occurrence. It is submitted that besides the petitioner being named by the spy, there is no other material against him. No incriminating article has been recovered from his possession and he is in custody since 9.5.2020.
The application for bail is opposed by learned APP for the State who submits that besides the instant case the petitioner is accused in one other case also. Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of petitioner together with the petitioner being in custody since 9.5.2020 and no incriminating article having been recovered from his possession, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Chapra Mufassil P.S. Case No. 188 of 2020 on his furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra.
