The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 354, 379, 504/34 of the Indian Penal Code.
The prosecution case, in short, is that the informant's niece was teased by the accused persons while she was going to defecate and on being complained, they came to the house of the informant and abused them.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The date of occurrence is said to 11.08.2017 while it
Patna High Court Cr.Misc. No.52580 of 2018(2) dt.10-09-2018 2/2 was registered on 13.8.2017. The delay has not been explained by the prosecution. As far as offence under Section 354 IPC is concerned, the same is superficial in nature. On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned learned A.C.J.M. Barh, Patna in connection with Salimpur P.S. Case No. 128/17, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
