====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 14-12-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Khodawandpur P.S. Case No. 125 of 2020, registered under Sections 401/414/353/307/332/34 of the Indian Penal Code read with sections 25(1-B0a, 26(i)(ii), 27 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 04.07.2020, and charge-sheet has been submitted, allegation is of recovery of country made pistol alongwith live cartridge and mobile. Learned counsel submits that petitioner has been falsely implicated in the present case as no recovery was made from the conscious possession of the petitioner.

Patna High Court CR. MISC. No.41319 of 2021(2) dt.14-12-2021 2/2 regular bail application of the petitioner as six antecedents are pending as mentioned in para -3 of the regular bail application. Considering the fact that the petitioner is in custody since 04.07.2020, charge-sheet has been submitted in this case against the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai in connection with Khodawandpur P.S. Case No. 125 of 2020, with a condition that the petitioner will mark his attendance in between 20-25 of every month commencing from January, 2022 in the concerned police station till framing of charge, in the event if it is reported by the concerned police station to the learned court below that the petitioner in between the aforesaid date in any of the month has not marked his attendance, the Court below will forthwith cancel his bail bond.
