The petitioner seeks bail in a case registered for the offence under Section 392 of the Indian Penal Code.

3. Unknown criminals looted the motorcycle in question. The name of the petitioner has come on the basis of confessional statement of co-accused, namely, Sumit Kumar who was caught on the spot.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case and nothing has been recovered from the conscious possession of the petitioner and petitioner is in custody since 14.10.2023. Similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 14888 of 2024.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Rampur Chauram P.S. Case No. 94 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Arwal with following conditions:- (i) The petitioner will mark his attendance at the Mahendiya Police Station, Arwal on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. (ii) The petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the court below.
