====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 11-09-2018 Heard Sri Yogendra Kumar Singh, learned counsel for the petitioner and Sri Sunil Kumar Pandey, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Aurangabad Town P.S. Case No. 121 of 2018 registered for offence under Sections 420, 406, 323, 504 of the Indian Penal Code, has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that the present case was instituted on the basis of complaint petition i.e. Complaint Case No. 81 of 2018. By way of referring to the complaint petition, it has been argued that it appears that there is partnership dispute in between the parties and in a civil dispute,

Learned Addl. Public Prosecutor has opposed the prayer for anticipatory bail.

However, considering the facts and circumstances, I am of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordignly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Md. Allauddin be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two surities of the like amount each to the satisfaction of learned C.J.M. Aurangabad in connection with Aurangabad Town P.S. Case No. 121 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J.) nawalkrs/- U T
