JUSTICE ANIL KUMAR SINHA ORAL ORDER 12-11-2020 Heard Mr. Anish Kumar, learned counsel for the petitioner and Mr. Chandra Bhushan Prasad, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Vaishali (Belsar O.P.) P.S. Case No. 181 of 2020 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation as per the First Information Report is that the house of the petitioner was raided by the Police and a total quantity of 237.300 litres of illicit foreign liquor has been recovered from the said house.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged

Patna High Court CR. MISC. No.25659 of 2020(3) dt.12-11-2020 2/2 and he has got no criminal antecedent. Learned counsel further submits that alleged illicit foreign liquor has been recovered from the house of the petitioner in which his brother also resides and the petitioner along with his brother has been made accused in this case. Learned counsel also submits that the petitioner is in custody since 6.6.2020.

Having heard learned counsel for the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent and he is in custody since 6.6.2020, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur, in connection with Vaishali (Belsar O.P.) P.S. Case No. 181 of 2020.

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
