JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-02-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 10.11.2020, within four weeks of starting of the Court proceeding in physical mode Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Nawadah Town P.S. Case No.382 of 2017/Special (N.D.P.S.) Case No.04 of 2017 registered under Sections 272 and 273 of the Indian Penal Code besides Section 30(a) of the Bihar Prohibition and Excise Act, 2016, Sections 25(1-b)a and 26 of the Arms Act and Sections 20 and 22 of the N.D.P.S. Act.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.30703 of 2020(2) dt.03-02-2021 2/2 submits that, earlier, the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 19.03.2020 passed in Criminal Misc. No.75142 of 2019 with a liberty to the petitioner to renew his prayer for bail after one year in custody. The petitioner is in custody since 17.07.2019, i.e., for more than one year.

Having regard to the facts and the circumstances of the case and considering the observation made by this Court in the order dated 19.03.2020 passed in Criminal Misc. No.75142 of 2019, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Nawada, in connection with Nawada Town P.S. Case No.382 of 2017/Special (N.D.P.S.) Case No.04 of 2017.
