The petitioner apprehends his arrest in connection with Sour Bazar P.S. Case no. 410 of 2015, registered under Sections 366A/ 34 of the Indian Penal Code.

Petitioner along with other accused persons are said to have kidnapped the minor daughter of the informant for committing her murder or sexual offence or for prostitution. It is submitted by the learned counsel appearing for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. Two named accused persons have been acquitted by the trial court. The victim has performed marriage with the petitioner out of her

Learned APP for the State vehemently opposing the bail petition submitted that the victim happens to be minor and in her statement recorded under Section 164 Cr.P.C. she has candidly stated that the petitioner along with other persons kidnapped her and petitioner and one Anmol Yadav committed rape twice against her.

Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for bail is hereby rejected. (Prakash Chandra Jaiswal, J) Trivedi/- U T
