1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.
3. Learned counsel for the petitioner submits that petitioner has antecedent of nine cases and allegation is of recovery of 146.88 litres of liquor from a car. It is next submitted that petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and is not the owner of the seized vehicle and he came to be implicated on the confessional statement of Bhola Yadav in police custody, which does not have any evidentiary value. It is also submitted that it appears that the police in order to save the real culprits
Patna High Court CR. MISC. No.34920 of 2024(2) dt.17-05-2024 2/2 got the petitioner implicated through Bhola Yadav and he is in custody since 24.03.2024.
4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.45000/- (Rupees forty five thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Yogapatti P.S. Case No.49/2024.
